1. Ownership of Platform Content

All content, design, and technology that make up the StudoKe platform are the exclusive property of EduHub Kenya and are protected by copyright, trademark, and other intellectual property laws of the Republic of Kenya.

This includes but is not limited to:

  • The StudoKe brand name, logo, and visual identity
  • Website and application source code, design, and user interface
  • Original text, descriptions, and editorial content created by StudoKe
  • Features, tools, and functionality developed for the platform
  • Database structure, layouts, and organization of content

No part of the StudoKe platform may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form without prior written permission from EduHub Kenya.

2. User-Generated Content

StudoKe hosts study materials, past papers, notes, and revision guides uploaded by students, lecturers, and contributors. The following terms apply to user-generated content:

2.1 Ownership by Users

Users who upload original study materials retain ownership of their work. StudoKe does not claim copyright over original notes, summaries, or revision materials created by users.

2.2 License to StudoKe

By uploading content to StudoKe, users grant EduHub Kenya a non-exclusive, worldwide, royalty-free license to:

  • Host, store, and display the content on the platform
  • Distribute the content to other registered users for educational purposes
  • Format and optimize content for web and mobile viewing
  • Create backups and ensure content availability

This license is limited to the operation of the StudoKe platform and does not grant StudoKe ownership of the uploaded content.

2.3 User Responsibility

Users are solely responsible for the content they upload. By uploading material, you represent and warrant that:

  • You are the original author of the content, or have the right to share it
  • The content does not infringe upon the copyright or intellectual property rights of any third party
  • The content does not contain confidential, leaked, or unauthorized examination materials

3. Institutional & Third-Party Content

StudoKe may reference or display content related to educational institutions, professional bodies, and examination councils. The following disclaimers apply:

Disclaimer: StudoKe is an independent educational platform. We are not affiliated with, endorsed by, or officially connected to any university, college, examination body, or government institution unless explicitly stated.

3.1 Institutional Names and Logos

Institutional names, abbreviations, unit codes, logos, and emblems (including but not limited to KMTC, Chuka University, KASNEB, and other Kenyan educational institutions) are the property of their respective owners. Their use on StudoKe is for identification and reference purposes only.

3.2 Past Examination Papers

Past examination papers and official institutional documents hosted on StudoKe are uploaded by users for educational study purposes. StudoKe does not claim ownership of these materials and acknowledges that they remain the intellectual property of the issuing institutions.

3.3 Textbook and Publisher Content

Commercial textbooks, published study guides, and proprietary educational materials are owned by their respective publishers. Users may not upload substantial portions of copyrighted published works without permission from the copyright holder.

4. Fair Dealing & Educational Use

StudoKe operates under Kenya's fair dealing provisions as set out in the Copyright Act, 2001 (Act No. 12 of 2001). Under Kenyan law, fair dealing is permitted for the following purposes:

  • Research or private study — Materials on StudoKe are provided to support academic research and private study by enrolled students
  • Criticism or review — Fair use of content for the purpose of commentary, criticism, or academic discussion
  • News reporting — Use of content for reporting on educational matters in the public interest
  • Quotation — Reasonable quoting of content for academic purposes with proper attribution

Educational Purpose: All materials hosted on StudoKe — including past examination papers, revision notes, and study guides — are provided strictly for educational, study, and non-commercial revision purposes. StudoKe does not authorize the use of its content for commercial exploitation, cheating, or academic dishonesty.

For fair dealing to apply, the use must be accompanied by sufficient acknowledgement of the source and must not exceed what is reasonable for the permitted purpose.

4.1 International Copyright Treaties

Kenya is a signatory to the Berne Convention, the Universal Copyright Convention, and the TRIPS Agreement. StudoKe respects these international obligations and cooperates with rights holders globally.

5. Prohibited Content

The following types of content are strictly prohibited on StudoKe and will be removed immediately upon discovery:

  • Leaked or confidential examination materials — Upcoming exams, sealed question papers, or confidential institutional documents
  • Copyrighted commercial textbooks — Substantial reproductions of published books, textbooks, or study guides without permission from the copyright holder
  • Private personal documents — Documents containing personal, sensitive, or private information about individuals without their consent
  • Answer keys or solutions — Official answer keys or marking schemes produced by examination bodies for internal use
  • Plagiarized content — Material copied verbatim from copyrighted sources without attribution or permission

Users who repeatedly upload prohibited content may have their accounts suspended or terminated in accordance with our Terms of Service.

6. Copyright Infringement Claims

StudoKe respects the intellectual property rights of others and expects our users to do the same. If you believe that content on StudoKe infringes upon your copyright, please follow our DMCA Takedown Procedure.

We will investigate and respond to valid copyright infringement claims in accordance with the Digital Millennium Copyright Act (DMCA) and applicable Kenyan copyright law.
