1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and EduHub Kenya ("we," "us," or "our") regarding your use of the studoke.com platform and related services.

By accessing or using our service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our service.

2. Eligibility

To use our service, you must:

  • Be at least 18 years old, or have parental/guardian consent if under 18
  • Be enrolled in or affiliated with a Kenyan educational institution
  • Provide accurate and complete registration information
  • Not be prohibited from using our service under applicable laws
  • Comply with all local, national, and international laws and regulations

We reserve the right to refuse service or terminate accounts that do not meet these eligibility requirements.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Security

You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage resulting from your failure to protect your account information.

3.3 Account Verification

We may require you to verify your email address or educational institution affiliation. Failure to complete verification may limit your access to certain features.

4. Acceptable Use Policy

You agree to use our platform only for lawful purposes and in accordance with these Terms. You are responsible for your conduct and any content you post, upload, or share.

Our platform is designed to: Help students access educational resources, collaborate with peers, and enhance their learning experience in a safe and supportive environment.

5. User Content

5.1 Your Content

You retain ownership of content you upload or share on our platform ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and improving our service.

5.2 Content Standards

All User Content must:

  • Be accurate and not misleading
  • Comply with applicable laws and regulations
  • Respect intellectual property rights
  • Not contain offensive, harmful, or inappropriate material
  • Not violate the privacy or rights of others

5.3 Content Moderation

We reserve the right to review, monitor, and remove User Content that violates these Terms or is otherwise objectionable, without prior notice.

5.4 Responsibility for Content

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy, quality, or reliability of any User Content posted on our platform.

6. Intellectual Property Rights

6.1 Our Rights

The platform, including its design, features, functionality, software, and content (excluding User Content), is owned by EduHub Kenya and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our platform for personal, non-commercial educational purposes, subject to these Terms.

6.3 Restrictions

You may not:

  • Copy, modify, or distribute our platform or content
  • Reverse engineer or attempt to extract source code
  • Remove or alter any copyright or proprietary notices
  • Use our platform for commercial purposes without permission
  • Create derivative works based on our platform

7. Academic Integrity

We are committed to supporting academic integrity and ethical learning practices.

Important: Our platform is designed to facilitate learning, not to enable academic dishonesty. Using our resources to cheat, plagiarize, or violate your institution's academic integrity policies is strictly prohibited.

You agree to:

  • Use our resources as study aids and learning tools only
  • Comply with your institution's academic integrity policies
  • Not submit User Content as your own original work if it is not
  • Not use our platform to facilitate cheating or academic misconduct
  • Give proper attribution when using others' work

8. Prohibited Conduct

You agree NOT to:

  • Violate any laws or regulations
  • Impersonate others or misrepresent your affiliation
  • Harass, bully, or threaten other users
  • Post spam, advertisements, or promotional content without permission
  • Distribute malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our service
  • Scrape or collect data without authorization
  • Share examination questions or answers before exams
  • Sell or commercialize access to our platform
  • Post content that is defamatory, obscene, or offensive
  • Violate others' privacy or intellectual property rights

9. Termination

9.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

9.2 By Us

We reserve the right to suspend or terminate your account and access to our service, without prior notice, for:

  • Violation of these Terms
  • Engaging in prohibited conduct
  • Fraudulent or illegal activity
  • Threats to the security or integrity of our platform
  • Extended periods of inactivity

9.3 Effect of Termination

Upon termination:

  • Your right to access our service immediately ceases
  • We may delete your account and User Content
  • Provisions of these Terms that should survive termination will remain in effect

10. Disclaimers and Warranties

OUR PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • Our service will be uninterrupted, secure, or error-free
  • User Content is accurate, reliable, or complete
  • Any defects will be corrected
  • Our servers are free of viruses or harmful components

We are not responsible for the accuracy, quality, or appropriateness of User Content. Use of our platform and reliance on any content is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUHUB KENYA SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions or technical failures
  • User Content or conduct of other users
  • Any damages arising from your use of our platform

Our total liability to you for any claims arising from your use of our service shall not exceed the amount you paid us in the 12 months preceding the claim, or KES 10,000, whichever is less.

12. Indemnification

You agree to indemnify, defend, and hold harmless EduHub Kenya, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of our platform
  • Your User Content
  • Your violation of any rights of third parties

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our service shall be resolved through:

  • Informal Resolution: We encourage you to contact us first to resolve disputes informally
  • Mediation: If informal resolution fails, disputes may be submitted to mediation
  • Arbitration: Unresolved disputes shall be settled by binding arbitration in Nairobi, Kenya

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EduHub Kenya regarding your use of our service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top
  • Notify you via email or platform notification
  • Provide a reasonable period for you to review the changes

Your continued use of our service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using our service.
